THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25362 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of shop No.124 of Penanagar, Somuloripalli Panchayat, Proddatur Mandal in YSR Kadapa District. While so, the Enforcement Deputy Tahsildar inspected the shop on 19.06.2015 and found some variation in the stock. A show cause notice was issued to the petitioner on 24.07.2015. Challenging the same, the present Writ Petition is filed.
In view of the nature of the allegations, this Court is not inclined to interfere with the pending enquiry or comment on the merits of the case at this stage. However, learned Counsel for the petitioner submits that, when the petitioner was unable to operate the e-pos machine, the manual entries were not taken into account while ordering suspension of the authorization.
Since the enquiry is pending before the third respondent, the third respondent shall conduct the enquiry in accordance with law by giving due opportunity to the petitioner and also take into consideration the entries made in the register before concluding the enquiry and pass appropriate orders thereon, within a period of thirty days from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
