HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.9529 of 2015 ORDER:

The petitioner/owner of the vehicle seeks quashing of the Order dated 09.04.2015 passed in S.C.No.523 of 2014 on the file of the Judge, Family Court-cum-Additional Sessions Judge, Anantapuramu, in so far as confiscation of M.O.1-Auto bearing No. AP 02 TA 2689 to the State is concerned. The property involved in this case is said to be an Auto bearing No. AP 02 TA 2689. At the conclusion of the trial in S.C.No.523 of 2014, the said vehicle has been directed to be confiscated to the State as nobody claimed the same. In spite of that, the petitioner claiming to be the owner of the vehicle has filed the present petition seeking to release the said vehicle in his favour.

Having regard to the facts and circumstances of the case, the petitioner is directed to file an appropriate petition along with relevant documents showing his ownership of the vehicle in question before the Court below and on such petition being filed the Court below shall consider the same and pass appropriate orders thereon in accordance with law. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending shall stand closed. _________________ M.S.K.
