THE HON'BLE SRI JUSTI CE M.GANGA RAO M.A.C.M.A.NO.487 OF 2011 JUDGMENT:

The appellant, the erstwhile Andhra Pradesh State Road Transport Corporation, filed this appeal aggrieved by the Award and decree dated 02.06.2005 passed in O.P.No.15 of 2003 by the learned Chairman, Motor Accidents Claims Tribunal-cum-II Additional District Judge, Madanapalle, granting compensation of Rs.3,90,000/- against the claim of Rs.10,00,000/- for the death of N.Jagannadham in a motor accident occurred on 15.09.2002.

However, during the course of arguments, it is brought to the notice of this Court by the learned counsel for the respondents-claimants that the respondents-claimants herein have preferred an appeal in M.A.C.M.A.No.3554 of 2011 for enhancement of the compensation against the very same Award, and the said appeal was allowed vide judgment dated 25.01.2012 enhancing the compensation from 3,90,000/- to Rs.5,10,000/-.

In view of the aforestated judgment in M.A.C.M.A.No.3554 of 2011 enhancing the compensation, this appeal has become infructuous. The M.A.C.M.A. is accordingly dismissed as infructuous. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
