ORDER:

The grievance of the petitioner in this writ petition is that his appeal preferred before the second respondnet on 17.05.2015 against entries made by the third respondent in the revenue record is not being taken up and disposed of.

2. Learned Government Pleader, on instructions, however, submit that the said appeal was already examined by the second respondent and on finding that a civil suit is pending between the parties, the said appeal was dismissed on 16.07.2015 in view of Section 8(2) of the A.P. Rights in Land and Pattadar Pass Books Act, 1971. A copy of the said order is also appended to the instructions, which show that copy of the petitioner is marked for service through the Tahsildar, SAKN Mandal.

3. Learned counsel for the petitioner, however, states that the petitioner has not received copy of the order so far.

4. In view of the disposal of the appeal of the petitioner, nothing further survives for consideration in the writ petition. However, the third respondent shall serve a copy of the order on the petitioner and forward the acknowledgement to the second respondent, as directed in the order dated 16.07.2015. Petitioner is also liberty to take appropriate steps, if he is aggrieved by the aforesaid order of the second respondent.

The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. ______________________ VILAS V. AFZULPURKAR, J September 29, 2015 DSK
