Petitioner contends that he is the owner and possessor of agricultural land to an extent of Acs.4.00 in Survey No.111/26 of Vallakonda Village, Kaghaznagar Mandal, Kumram Bheem, Asifabad (erstwhile Adilabad) District. According to petitioner, though his name was mutated in the revenue records, the name of his late father is still appearing in the online pahani copies. While so, the 6th respondent is trying to interfere with his peaceful possession and enjoyment; created false documents and tried to encroach into his land. Therefore, he filed O.S.No.138 of 2013, which is pending on the file of Junior Civil Judge, Sirpur, Kumram Bheem Asifabad District.

This Writ Petition is filed to declare the action of the respondent authorities in trying to dispossess the petitioner from the subject land as illegal and refers to notice issued on 15.07.2017 to conduct survey as the basis to knock the doors of this Court.

Learned counsel for the petitioner submits that the averments filed in support of the Writ Petition as well as the prayer thereof would disclose that the property claimed by the petitioner is in Survey No.111/26, whereas survey proposed to be conducted is in Survey No.111/52.

Admittedly, the petitioner has brought to the notice of the Tahsildar that he has nothing to do with the survey conducted in Survey No.111/52. However, except making allegations against the 6th respondent and the alleged survey, no other material is placed on record as to how the respondent authorities are trying to interfere and dispossess the petitioner from the subject land. 6.

Apparently, the grievance of the petitioner is against the 6th respondent. It appears, petitioner also lodged a complaint against the 6th respondent before the Station House Officer, Sirpur Kaghaznagar Police Station. Therefore, no case is made out for granting the relief as prayed for by the petitioner. 7.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to work out his remedies, if so advised, against the alleged interference by the 6th respondent. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
