ORDER
The grievance of the petitioner is that as per the conceding request of the petitioner to conduct survey on payment of necessary costs, respondent No.3 issued a notice on 31.12.2014 directing him to produce the original documents fixing the date for survey on 9.1.2015. The petitioner approached the respondents with all the relevant documents.
However, as a precondition for conducting the survey, the 3rd and 4th respondents insisted the petitioner to sign on blank white papers. As the petitioner had refused to sign on white papers , the 3rd and 4th respondents had not conducted the survey and they are not proceeding further. The insistence of 3rd and 4th respondents to sign on blank white papers and hand over the same to them is illegal, arbitrary and unauthorized. In the circumstances, the petitioner prays a direction by this Court to complete the survey in accordance with law.
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The notice dated 31.11.2014, which is on record, indicates that a direction was issued to the petitioner
to produce original records to enable the authorities to conduct survey. If the assertion of the petitioner is believed that the respondent authorities directed him to sign on blank white papers, the said action of the respondents would be totally unauthorized and illegal. In the circumstances, the respondent authorities are directed to complete the survey and fix boundaries as per FMB 8-A sketch of the petitioner's land with respect to Sy.No.1005/1 and 1006/1, Pulikallu Village, Penumuru Mandal, Chittoor District, as expeditiously as possible, within a period of eight weeks from the date of receipt of a copy of this order. The petitioner shall furnish the order copy along with covering letter to the respondent-authorities to enable them to proceed further.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
