THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9899 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime No.97 of 2023 on the file of Shalibanda Police Station, Hyderabad, registered for the offences under Sections 353, 332, 307 and 506 of IPC and Section 25 (1) (a) of Arms Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant who is the Police Constable is that while he was performing his duties, he came across group of five persons including this petitioner. There was a quarrel going on and the de-facto complainant who was on duty intervened. A-1 took a knuckle punch and gave a punch on L.W.1's face resulting in bleeding injury.

As far as this petitioner is concerned, there are no over tacts attributed to this petitioner.

In the said circumstances of the case, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:

i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties, for a like sum each to the satisfaction of XVI Additional Chief Metropolitan Magistrate, Hyderabad.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer, everyday at 10:00 a.m., for the purpose of investigation, as and when required.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
