ORDER:

This Writ Petition is filed for a Mandamus to set aside proceedings, vide Rc.B.94/2009, dated 09.02.2009, of respondent No.2, whereby he has suspended the petitioner's fair price shop authorisation of Shop No.131 of Kallur Mandal, Kurnool District.

This Court by order, dated 16.3.2009, granted interim suspension of the impugned order.

At the hearing, learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh) submitted that in pursuance of the said interim order, the petitioner's fair price shop authorisation has been restored and that in view of the pendency of this Writ Petition, respondent No.2 has not completed the enquiry and passed a final

order.

As the scope of this Writ Petition is confined to suspension of the petitioner's fair price shop authorization pending enquiry, I do not find any justification for respondent No.2 in not completing the enquiry and passing a final order.

Respondent No.2 is, therefore, directed to complete the enquiry and pass a final order, as expeditiously as possible and not later than two months from the date of receipt of a copy of this order, and take further action depending upon the nature of the order he may pass. Subject to the above direction, the Writ Petition is disposed of.
