THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7768 of 2016 ORDER:

This Criminal Petition, under Section 438 Cr.P.C., is filed by the petitioner-A2, seeking to grant anticipatory bail in CC No.245 of 2015 on the file of Judicial Magistrate of First Class, Mahabubabad, arising out of Crime No.35 of 2015 of Dornakal Police Station, Warangal, registered for the offences punishable under Sections 420, 447 and 506 IPC.

Heard and perused the material available on record. The case of the prosecution is that the father of the petitioner i.e. A1, sold the property belonging to himself and the petitioner to de facto complainant for a considerable amount. The de facto complainant paid part of amount and A1 registered his part of land in favour of the de facto complainant and postponing registration of the land belonging to the petitioner. When the de facto complainant asked for registration of the land of the petitioner, A1 intimidated and refused to register the land of the petitioner. Hence, the de facto complainant filed the present complaint.

Learned counsel for the petitioner submitted that the petitioner is no way concerned with the offence alleged against her and that after completion of investigation, police filed charge sheet against the petitioner and A1 and the Court below issued NBWs against the petitioner and the petitioner is ready to face the trial and hence, the NBWs may be recalled.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

In the circumstances, the petitioner is directed to surrender before the Court below, and file an application for recalling the warrant

issued against her. On filing of such application, the Court below is directed to recall the warrant, on petitioner executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum. The petitioner is further directed to appear before the Court below regularly.

Accordingly, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, shall stand closed. ______________ RAJA ELANGO, J June 14, 2016.
