IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 38808 of 2015 BETWEEN P.Shobha and others ... PETITIONERS AND The State of Telangana, rep. by its Principal Secretary and others ...RESPONDENTS Date of Order pronounced: 04.12.2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

2. Petitioners approached this Court by the present writ petition alleging that the fourth respondent and his sub ordinates are interfering with their possession and enjoyment over the allotted lands, on which they were taking up constructions as per the sanction.

3. Learned Government Pleader for Revenue has since received instructions submits that the petitioners were no doubt allotted plots, but they have never taken up constructions as per the conditions of assignment, but they have now taken up construction in the year 2014 and has stated that the constructions are sanctioned by the Gram Panchayat, Manikonda. However, since petitioners were trying to encroach on the adjacent land while taking up constructions, the objection was raised and as long as petitioners confine themselves to their allotted lands, there will be no interference by the fourth respondent.

4. It is therefore clear from the above that if the petitioners confine themselves to their possession and enjoyment including construction of their respective plots within the boundaries thereof without encroaching on any other land in accordance with the sanction accorded to them, there shall be no interference by the fourth respondent. With the above direction, writ petition is disposed of. As a sequel the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
