THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos. 34612 & 34725 of 2015 COMMON ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for the respondents.
2. The petitioners are Fair Price Shop Dealers of Shop No.3 of Abdullapuram Village and Shop No.33 of Nagisettipalli Village in Kolimigundla Mandal of Kurnool District, respectively. When the authorization of the petitioners was subsisting, the same was suspended by the 3rd respondent by proceedings dated 30.04.2015 pending enquiry in respect of the allegations leveled against the petitioners. The petitioners filed W.P.Nos.17842 of 2015 and 17858 of 2015 respectively and this Court disposed of the said writ petitions on 19.06.2015 directing the 2nd respondent to dispose of the appeals preferred by the petitioners. The 2nd respondent, in turn, remanded the matter to the 3rd respondent for passing orders after conducting due enquiry. When the 3rd respondent did not pass any orders even after remand by the 2nd respondent, these writ petitions are filed.
3. The authorization of the petitioners was suspended way back in April, 2015 and the petitioners have submitted their explanations. The 3rd respondent should have conducted an enquiry and passed final orders in respect of the allegations leveled against the petitioners within a period of three weeks. Since the 3rd respondent did not pass any orders after conducting an enquiry, the 3rd respondent is directed to conduct an enquiry and pass final orders in respect of the allegations leveled against the petitioners within a period of thirty (30) days from the date of receipt of a copy of the
order.
The Writ Petitions are accordingly disposed of.
Consequently, Miscellaneous petitions, if any, pending in the writ petitions shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 26th October, 2015 cbs THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO
