This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.159 of 2022 pending on the file of Station House Officer, Tukaramgate Police Station, Hyderabad registered for the offence punishable under Section 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substance Act, 1985.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The Petitioner was caught by the Tukaramgate Police while transporting nearly 15 kgs of Ganja. The Petitioner was apprehended on 26.07.2022 along with the contraband and sent to judicial custody after following the procedure prescribed under NDPS Act. 4.

Learned Assistant Public Prosecutor on instructions would submit that there are no other criminal antecedents against this petitioner.

Keeping in view that the contraband being less than commercial quantity and there being no other criminal cases of similar in nature against this Petitioner, the prayer for regular bail can be considered on conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused is directed to be released on bail on his executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for a like sum to the satisfaction of Metropolitan Sessions Judge, Hyderabad.

ii) After release on bail, the petitioner/Accused shall appear before the concerned police station on every Monday and Thursday between 10.00 A.M to 1.00 P.M, for a period of twelve (12) weeks or until filing of charge sheet, whichever is earlier. iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
