CIVIL MISCELLANEOUS APPEAL No. 1072 OF 2016 J U D G M E N T : [O R A L] { Per the Hon'ble Sri Justice Suresh Kumar Kait } Aggrieved by the order dated 27/06/2016 passed in Divorce OP.No. 592 of 2014 by the Principal District Judge, Vizianagaram, dismissing the petition filed by the petitioner under section 10 of the Indian Divorce Act, seeking dissolution of the marriage between the petitioner and the respondent by way of divorce, this Civil Miscellaneous Appeal is filed.

2. On 05/01/2017 this Court admitted the above Civil Miscellaneous Appeal.

3. Pursuant to letter dated 08/02/2017 of the counsel for the appellant requesting the Registry to list the above CMA under the caption 'for withdrawal' of the above appeal on the ground that

both the parties have settled the matter and are living together, the matter is listed.

4. In view of the request made by the counsel for the appellant, this Civil Miscellaneous Appeal is dismissed as withdrawn. No costs.
