HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23818 of 2016 ORDER:
1. The petitioner was appointed as a Cashier in the cadre of Sales Man at Yelleswaram, East Godavari District, Andhra Pradesh by the respondent Corporation on 16.12.1977.
Subsequently, he was promoted as Senior Stores Assistant and was continued as such till his retirement on 31.01.2012. As on the date of retirement, he claims that an amount of Rs.19,33,990-50 paise was due to him towards Gratuity, Employees Provident Fund, Group Saving Linked Insurance, Encashment of Earned Leave Salary etc., All the amounts were paid except Rs.3,63,219/-.
He submitted several representations on 28.12.2012, 09.02.2013, 04.03.2013 and 03.12.2014 to release the balance amount. He also approached the Human Rights Commission by submitting a representation on 15.12.2015. The respondent, instead of releasing the amount, issued several proceedings on 08.02.2016 and 21.03.2016 claiming an amount of Rs.3,25,022-57 paise from the petitioner and the petitioner submitted his detailed explanation on 04.05.2016. When the said representation was not considered, he sent a notice through his Counsel on 01.07.2015. The present writ petition is filed when there was no response from the respondent.
2. In view of the disputed facts, this Court is not inclined to examine the various contentions raised by the petitioner. However, in view of the claim made by the respondent against the petitioner and the explanation of the petitioner dated 04.05.2016, the respondent is directed to consider the detailed explanation submitted on 04.05.2016 to the demand made by the respondent
for an amount of Rs.3,25,022-57 paise and determine the balance amount payable to the petitioner within a period of three months from the date of receipt of a copy of this order and pay the said amount.
3. The Writ Petition is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
