THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.24071 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Prohibition & Excise.
Pending confiscation proceedings, an application was filed by the petitioner herein for release of the stocks. The Deputy Commissioner of Prohibition & Excise, Mahabubnagar Divisionsecond respondent herein passed an order on 17.05.2017, directing release of the stock, subject to the petitioner furnishing FDR for Rs.5,00,000/-.
Questioning the above said order, W.P.No.17898 of 2017 was filed before this Court. The said Writ Petition was disposed of by this Court, by way of an order, dated 06.06.2017, reducing the amount from Rs.5,00,000/- to Rs.3,00,000/-. Subsequently, the petitioner herein, by way of a representation, dated 08.06.2018, approached the second respondent, requesting for reduction of FDR from Rs.3,00,000/- to Rs.1,50,000/.
On the said representation, the second respondent herein passed the impugned order, dated 26.06.2018, rejecting the request of the petitioner herein. Since this Court has already passed an order on 06.06.2017 in W.P.No.17898 of 2017, reducing the amount from Rs.5,00,000/-to Rs.3,00,000/-, the question of further
reduction by the Deputy Commissioner does not arise nor the present Writ Petition can be entertained for reduction of the said amount already fixed by this Court in the earlier Writ Petition. Therefore, this Court does not find any merit in the Writ Petition.
Accordingly, Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
