Heard learned counsel for the petitioner, learned Government Pleader for Mines and Geology for respondents 1 and 2 and learned Government Pleader for Revenue for respondents 3 and 4.
The case of the petitioner is that it has been granted mining lease for lime stone vide G.O.Ms.No.501 dated 31.12.2002 in respect of land admeasuring 1.951 hectors in Survey No.574/2B, Vemavaram Village, Machavaram Mandal, Guntur District, for a period of 20 years and a lease deed was executed on 21.03.2003. Accordingly, the petitioner is quarrying operations in the mining lease area. However, as the 3rd and 4th respondents are trying to allot the adjacent lands of the petitioner to some third parties, the petitioner made a representation dated 15.06.2016 to the 4th respondent and in pursuance of the same, the 2nd respondent vide proceedings dated 02.07.2016 requested the 4th respondent not to take any steps for allotment of house site pattas adjacent to the mining lease area of the petitioner.
The grievance of the petitioner is that despite issuance of proceedings dated 02.07.2016 by the 2nd respondent to the 4th respondent, the 3rd and 4th respondents, without considering the said proceedings, are trying to allot house site pattas to the third parties adjacent to the petitioner's mining lease area. Hence, the writ petition.
Having regard to the facts and circumstances of the case, the 4th respondent is directed to consider the representation dated 15.06.2016 of the petitioner and take appropriate action in accordance with law, after issuing notice to the affected parties. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
