The petitioner has filed this writ petition seeking to direct the respondents to grant pattas to the petitioners for the lands in Sy.Nos.497/2, 495/5, 494/2, 494/3, 495/7, 494/5, 494/6, 494/8, 496/3, 484/2, 484/9, 495/2, 495/3 and 470/3 in an extent of Ac.1.48 cents; 0.69 cents, Ac.2.35 cents; Ac.1.51 cents; Ac.1.98 cents; Ac.1.78 cents; Ac.1.19 cents; Ac.2.35 cents; Ac.1.68 cents, Ac.1.60 cents; Ac.1.93 cents, Ac.1.09 cents; Ac.1.68 cents and Ac.3.95 cents respectively, situated at Adigarlapalem, H/o Thutipala Village, Makavarapalem Mandal, Visakhapatnam District.

It is the case of the petitioners that they are in possession and enjoyment of the above lands and doing cultivation for the past several decades. The Tahsildar, who is the third respondent in this writ petition has issued a show cause notice for evicting them summarily, to which, the petitioners filed their reply. That apart, they also made a representation before the respondents seeking grant of pattas since they are land less poor. 3.

The matter is pending before this Court from 2007 onwards and there is an interim order dated 09.05.2007 in favour of the petitioners and this Court granted stay of operation of the notice and the balance of convenience is also in favour of the petitioners.

During the course of arguments, the learned Government Pleader for Revenue vehemently contended that it becomes necessary for the first respondent to look into the earlier orders passed by him and respondents 2 and 3 at the time of passing final orders.

Accordingly, the writ petition is disposed of, directing the petitioners to file their individual representations before the first respondent within a period of one month from today and the first respondent shall consider the same in accordance with law and pass appropriate order within a period of three months thereafter. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
