HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.24388 of 2018 ORDER:

This writ petition is filed aggrieved by the action of official respondents in pressurizing the petitioners to settle the matrimonial issue between the 1st petitioner and the 6th respondent.

Learned Assistant Government Pleader for Home basing on written instructions submits that on the complaint lodged by the 6th respondent, a case in Cr.No.250 of 2017 was registered for the offences punishable under Sections 109, 417, 420, 506 read with Section 34 IPC on 20-11-2017. It is further stated that respondent-police never threatened the petitioners except registration of crime and except proceeding with the investigation in the case as contemplated under law. The respondent-police never pressurized the 1st petitioner to sign M.O.U. dated 11-02-2018. The petitioners are required in connection with the above case. Instead of cooperating with the investigating agency by submitting the real facts, to escape from their criminal overt acts in the commission of offence, the petitioners with a malafide intention to divert the investigating agency filed the present writ petition.

Learned counsel for the petitioners says that the registration of crime itself is illegal, as the 6th respondent is not resident of Khammam, but learned Assistant Government Pleader for Home says that the 6th respondent has given address of Khammam, when she gave complaint to the police.

The FIR is already challenged in Crl.P.No.7039 of 2018 and the same is pending. More so, the registration of crime is not being challenged in the present writ petition.

In view of the same, the writ petition is disposed of directing the respondent-police not to interfere with the matrimonial disputes except in accordance with law. However, the petitioners shall cooperate with the investigation. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 23-07-2018 Nvl
