ORDER:- Heard.
2. The order impugned is the one passed under Section 47A of the Indian Stamp Act, 1899. The said order is clearly appealable under Section 47A(4) and under Section 47A(5)(ii) appeal is provided to the regular court. In the present case, appeal would lie before the appellate authority as specified under the said Proviso.
3. In view of the said efficacious alternative remedy available, petitioner is relegated to the said appellate remedy and since the time from the date of the impugned order has elapsed during pendency of this writ petition, petitioner is at liberty to present the appeal within two weeks from today which shall be entertained by the appellate authority without raising any objection as to limitation.
Writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
