THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9898 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 & 2 seeking bail in the event of their arrest in connection with Crime.No.786 of 2023 on the file of Pet Basheerabad Police Station, Cyberabad, registered for the offences under Sections 406 and 420 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant is that he was cheated in the process of getting visa being processed. However, in the complaint it is not specifically stated that money was collected by these petitioners. The Police have issued notice under Section 41-A Cr.P.C and reply was given through registered post but petitioners did not appear in person apprehending arrest. 4.

Keeping in view that money was not directly paid to these petitioners even according to the instructions of the learned Additional Public Prosecutor, the prayer of anticipatory bail can be considered, subject to following conditions:-

1) The petitioners/Accused Nos.1 & 2 are directed to surrender before the Station House Officer, Pet Basheerabad Police Station, Ranga Reddy District, on or before 19.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused No.1 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of four weeks and petitioner No.2 for a period of eight weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
