HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45937 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to declare the inaction of the respondents in conducting survey in respect of the land in survey Nos.13 and 14 of Kongara Khurd-A Raviryal Village, Maheswaram Mandal, Ranga Reddy District, as arbitrary and illegal.
Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue. With their consent, the Writ Petition is disposed of at the stage of admission itself. The limited grievance of the petitioner in this writ petition is that though he approached the 3rd respondent for conducting survey and demarcation of the subject land by submitting an application on 05.09.2015 through Mee-Seva vide transaction ID No.DER021500064608 by paying necessary charges, till date no orders passed.
Learned AGP would submit that since the subject land is converted into plots, the question of conducting survey does not arise.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent to consider the application made by the petitioner on 05.09.2015 for conducting survey in respect of the land in survey Nos.13 and 14 of Kongara
Khurd-A Raviryal Village, Maheswaram Mandal, Ranga Reddy District, and pass necessary orders thereon, in accordance with law, duly taking into consideration the objection raised, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.
