THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22402 of 2017 ORDER:

This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the respondents in notifying auction of leasehold rights and insisting the petitioner to vacate from the land belongs to Yoganadha Lakshmi Narasimha Swamy Temple, Vijjeswaram, Nidadavole, in an extent of Ac. 2.61 cents in R.S.No.136 of Madduru Village, during pendency of petitioner's application, dated 21.01.2017, as illegal, irregular, arbitrary, without jurisdiction, violative of principles of natural justice and provisions of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, and Rules framed there under and offends Articles 14, 21 and 300A of Constitution of India and consequently direct the respondents to continue the petitioner in possession of his tenancy holding land.

When the matter is taken up for hearing, learned counsel for the petitioner informed this Court that the writ petition becomes infructuous since the 3rd respondent has already passed an order in R.C.No.A4:833/2016, dated 03.07.2017, rejecting the petitioner's application for renewal lease period and declining to grant status as landless poor person and proposed to conduct auction to land in extent of Ac.2.61 cents in R.S.No.136 of Madduru Village, which is belonging to 4th respondent temple, i.e., Yoganadha Lakshmi Narasimha Swami Temple, Vijjeswaram, Nidadavole, and that the said order is also challenged in

RE,J W.P.No.22402 of 2017 W.P.No.24317 of 2017 and prays to dismiss the present writ petition as infructuous.
