HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.26879 of 2017 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Home (AP) and, with their consent, the writ petition is disposed of at the stage of admission. The inaction of respondent Nos.2 to 4, in considering the representations dated 20.12.2016 and 15.11.2015 to close the rowdy sheet and suspect sheet, is questioned in this writ petition as being illegal and arbitrary. In his counter, the Sub-Divisional Police Officer, North Sub-Division, Guntur District (respondent No.2) would state that the representations of the petitioners were, in fact, considered and rejected directing to retain upto 31.12.2017. Opening of rowdy sheet impinges right of the petitioner both under Articles 19 and 21 of the Constitution of India and, unless compelling circumstances are present requiring rowdy sheet to be continued, rowdy sheet shall not be continued in a routine manner (K.Suresh Babu v.

Superintendent of Police, Ananthapur District1). In as much as the representations of the petitioner were rejected, liberty is given to the petitioner to submit a fresh representation making out a case for withdrawal of rowdy sheet and suspect sheet. Respondents shall consider such representation as and when made.

The Writ Petition is accordingly disposed of. 1 2016(1) ALD (Crl.) 210
