HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.15974 of 2015 ORDER:

Heard Sri P. Govinda Rajulu, learned counsel appearing for the petitioner and Sri A. Ravi Babu, learned standing counsel for TSRTC.

2. The petitioner is working as driver in the 3rd respondent Depot. A privilege bus pass enroute from Venkatapur to Thirupati was issued to the son of the petitioner. It is stated that the said bus pass was misplaced while the son of the petitioner was travelling from Huzurabad to Hanumakonda. According to the petitioner, immediately he lodged a written complaint on 20.04.2015 before the 3rd respondent. The 3rd respondent by letter dated 23.04.2015 sent notice to the Squad informing the fact that the bus pass was issued to the petitioner's son was lost on 22.04.2015. In the course of check exercised by the checking officials, the bus pass was found with a lady passenger. Subsequently, suspension orders dated 04.05.2015 was passed against the petitioner and a charge sheet was also simultaneously issued.

3. Learned counsel appearing for the petitioner submits that in fact the bus pass was lost while his son was travelling in the bus and genuinely he made a complaint to the Corporation on 20.04.2015. On the other hand, learned standing counsel for the Corporation submits that a charge was framed against the petitioner to the effect that the complaint submitted by the petitioner was received by the Corporation on 22.04.2015 and misled the Corporation by mentioning in the complaint that it was submitted on 20.04.2015.

4. Having regard to the rival contentions submitted by the counsel on either side, this court is of the opinion that an enquiry needs to be conducted in to the charges levelled against the petitioner.

5. Under these circumstances, the respondents are directed to receive the explanation from the petitioner to the charges levelled against him and conduct enquiry and pass final orders in accordance with Rules, with in a period of eight (8) weeks from the date of receipt of a copy of this order.

6. The writ petition is accordingly disposed of at the stage of admission. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
