THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27510 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons disclosed in the accompanying Writ Affidavit, it is prayed that this Honourable Court may be pleased to issue a Writ, Order or Direction in the nature of Mandamus by declaring the inaction of the Official Respondents on the notice of the Petitioner's Counsel dated 15.11.2019 as arbitrary, illegal, colourable exercise of power violative of Art. 14 of the Constitution of India and further direct Official Respondents to forthwith remove the illegal and unauthorized shed put up by the 4th Respondent in the park area of 929 sq. yards on and towards the north of Plot No. 50 belonging to the 4th Respondent situated at Srinivas Nagar Colony, Lingojiguda, Saroornagar Mandal, Ranga Reddy District and be pleased to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard Sri Sunil B.Ganu, learned counsel appearing for the petitioner, learned Government Pleader for Municipal Administration & Urban Development appearing for the 1st respondent and Sri Sampath Prabhakar Reddy, learned standing counsel appearing for respondents 2 & 3. Perused the material available on record.

It is the case of the petitioner that the unofficial 4th respondent is raising unauthorized shed in the park area admeasuring to an extent of 929 square yards towards North of Plot No.50 belonging to the 4th respondent, situated at Srinivas

TA,J W.P.No.27510 of 2019 Nagar Colony, Lingojiguda, Saroornagar Mandal, Ranga Reddy District. The petitioner has also brought to the notice of the official respondents about the said fact by way of filing a representation, dated 15.11.2019, but till now no action has been initiated against the unofficial 4th respondent. Hence, the present writ petition is filed.

Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the 3rd respondent to consider the representation, dated 15.11.2019, of the petitioner and pass appropriate orders, after affording a reasonable opportunity to all affected parties, if required, in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of this order. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
