Heard the learned counsel for the petitioner and Sri N.Praveen Kumar, learned Standing Counsel, appearing for 2nd respondent. It is the case of the petitioner that he purchased a house plot to an extent of 225 sq yds in plot No.30, 31 (part) in Sy. No.222 (old), 222/a (new), situated at Sai Tulasi Enclave-I, Vattinagulapally village, Gandipet Mandal, Ranga Reddy District, from his vendors M/s.Sai Surya Infra Developers and others vide registered sale deed doc. No.6241 of 2017 and that he also paid Rs.11,700/- on 27-03-2018 in the treasury of SBI vide Challan No.12703 to the then Gram Panchayat, Vattinagulapally, and obtained permission vide GP 157/BP/No.18/19 dt.28-03-2019 for construction G+2 floors. But to his surprise, on 06-12-2019, the respondents visited his site which is under construction and threatened to demolish the same. Hence, the present Writ Petition.
Sri N. Praveen Kumar, learned Standing Counsel for the respondents, on instructions, submits that the order issued by the Gram Panchayat dt.28-03-2019, prima facie, appears to be not genuine. However, the respondents would verify regarding the correctness of the said document and then only take necessary action.
In view of the same, this Court feels that the Writ Petition can be disposed of with certain directions.
Accordingly, the Writ Petition is disposed of directing the respondents not to interfere with the construction of the petitioner's property. However, the respondents are at liberty to verify the documents of the petitioner and take necessary steps by following due process of law, after giving reasonable opportunity to the petitioner. No costs.
