THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8004 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.2 & 3 in connection with S.C.No.184 of 2022 on the file of I Additional Metropolitan Sessions Judge, Hyderabad, in Crime No.326 of 2021 on the file of Secunderabad Railway Police Station, Secunderabad, registered for the offences punishable under Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against these petitioners is that they were found with 72 Kgs. of Ganja which was underneath their berths. As per the charge sheet it was A1 who has placed the said contraband underneath their berths and the police had arrested these petitioners and remanded to judicial custody on 03.12.2021. 4.

Learned Assistant Public Prosecutor on instructions would submit that there are no cases pending against these petitioners.

Learned Counsel for petitioners submits that they have little children to take care and even according to charge sheet, the contraband was placed by A1.

Since the investigation is complete and keeping in view that the petitioners are women and having small children, the petitioners can be granted the relief of bail subject to the following conditions: i) The petitioners/A2 & A3 shall execute personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each, among which one is local surety and the other is native surety, to the satisfaction of I Additional Metropolitan Sessions Judge, Hyderabad. ii) The petitioners/A2 & A3, after release shall appear before the concerned Court, on every date of hearing, failing which the prosecution is at liberty to move for cancellation of bail. iii) The petitioners/A2 & A3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 8.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date:13.09.2022 tk
