HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24143 OF 2018 O R D E R :

This writ petition is filed challenging the action of respondents 2 and 3 in not taking any action on the complaint of the petitioner dated 27.06.2018. Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that the petitioner and one Bibijan gave a complaint to the 3rd respondent stating that the 4th respondent and antisocial elements trespassed into her mulgi and damaged the shop; that later Bibijan came to police station and submitted a compromise letter entered into between Mutavalli and Bibijan, regarding paying of license fees and also stated that she is again running the shop;

that on such submission of compromise, the respondent No.3 has called the petitioner to the police station, but as petitioner did not turn up, basing on the above compromise, the 3rd respondent has issued notice to the petitioner on 13.07.2018 through registered post stating that the said Bibijan has submitted the compromise letter and further advised the petitioner to approach the concerned civil court as the matter is relating to wakf property.

Recording the aforesaid submission of learned Assistant Government Pleader, the writ petition is disposed of granting liberty to the petitioner to avail alternate remedy as may be available to him under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 20.07.2018 t k.
