THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1075 OF 2014 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the charge sheet filed in P.R.C.No.73 of 2013 on the file of the Judicial First Class Magistrate, Adoni, arising out of offences under Sections 147, 148, 332, 353, 307, 448 and 452 IPC read with Section 149 IPC.

Learned counsel for the petitioners after arguing for some time, when this Court expresses its opinion that this Court is not inclined to interfere with the proceedings in P.R.C.No.73 of 2013, seeks permission to withdraw the criminal petition with liberty to file application seeking dispense with the presence of the petitioners.

The criminal petition is accordingly dismissed as withdrawn giving liberty to the petitioners to file an application seeking dispensing with their presence before the Court below and the Court below is directed to decide the application on merits in accordance with law. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
