THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27019 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the inaction of the respondent no.2 in considering and disposing of the ROR appeal no.1545/2016 filed by the petitioner on13-52016 for deletion of wrong entries made in favour of unofficial respondent in respect of land admeasuring Ac.1-35 gts., in Sy. No. 862/C/1342 situated at Fort Warangal, Warangal(M) of Warangal District as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondent no.2 to dispose of the said appeal within a reasonable time."
Heard Sri K. Vinaya Kumar, learned counsel for the petitioner and learned Government Pleader for Revenue for the State of Telangana for respondents.
The only grievance of the petitioner in the present writ petition is non disposal of the appeal, dated 13-05-2016 preferred by the petitioner herein before the Revenue Divisional Officer, Warangal - 2nd respondent herein.
Having regard to the nature of controversy and for the reasons stated in the affidavit filed in support of the writ petition, this Court is of the considered opinion that the ends of justice would be served if the 2nd respondent is directed to pass appropriate orders on the appeal, dated 13-05-2016 preferred by the petitioner herein by fixing some timeframe.
For the aforesaid reasons, the writ petition is disposed of, directing the 2nd respondent - the Revenue Divisional Officer, Warangal to pass appropriate orders on the appeal, dated 13-052016 said to have been filed by the petitioner vide appeal No.1545 of 2016, within a period of three (3) months from the date of receipt of a copy of this order, after giving notice and opportunity of bearing heard to the petitioner herein.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
