THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.12936 of 2015 ORDER:

This criminal petition is filed under Section 482 Cr.P.C seeking a direction to the learned II Additional Judicial Magistrate of First Class, Rajahmundry to pass appropriate orders in CC(SR) No.6223/2013 pending on his file. Heard the learned counsel for the petitioner. Briefly stated the allegations are that the petitioner filed a private complaint making certain allegations against respondents Nos.2 to 8 on the file of the II Additional Judicial Magistrate of First Class, Rajahmundry on 10.06.2013 and the same was registered as CC(SR) No.6223/2013. The complaint was returned on 12.06.2013. It was resubmitted on 17.06.2013. The said complaint was again returned on 30.07.2013 and the same was represented on 19.12.2013. Thereafter, it is alleged that the learned Magistrate has neither taken cognizance of the complaint nor did he return the same, and the same has been pending ever since then.

If what alleged in the petition is true, the learned II Additional Judicial Magistrate of First Class, Rajahmundry is directed to pass appropriate orders on CC(SR).No.6223/2013 pending on his file, within a period of 3 (three) days from the date of receipt of a copy of this order.
