HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 21565 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) The petitioner, in the instant writ petition under Article 226 of the Constitution of India, seeks notional promotion with effect from 2001 by filing a writ petition in 2015 and that too after his retirement. After retirement of the petitioner, it appears he made a representation on 07.03.2015 and it was replied by the Principal District Judge rejecting his claim. Merely because his claim was rejected in April, 2015, it cannot be stated that the petitioner approached this Court within reasonable time from the date on which he was due for promotion. In any case, promotion is not a right of an employee.
Keeping that in view, we dismiss this writ petition on the ground of delay and laches.
Consequently, miscellaneous petitions, if any, also stand disposed of.
