HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.6277 OF 2016 ORDER:

The petitioner, who is A.1 in Crime No.25 of 2016 of Peddamul Police Station, Ranga Reddy District, filed this criminal petition under Section 438 of Cr.P.C., seeking release in the event of his arrest in connection with the above crime registered for the offence punishable under Section 420 IPC r/w. 34 IPC.

The case of the prosecution is that A.2 and the complainant are friends and hostel mates at Peddemul Village. A.2 induced the complainant by making false promise that he would secure a Home Guard job in Police Department for him. A.2 introduced A.1. Believing the words of A.2, the informant gave Rs.75,000/- and Rs.80,000/- each. A.1 and A.2 also collected various amounts from several persons, who are all residents of Rakamcherla village, Chengomul Mandal. Failure to fulfill the promise lead to registration of the present case. It is to be noted that A.2 was arrested and released on bail. Hence, the petitioner, if so advised, shall surrender before the Police Station concerned and move an appropriate application before the Court concerned seeking bail, in which event, the same shall be dealt with on the same day in accordance with law.

Subject to the above directions, the Criminal Petition is dismissed.
