THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.14845 OF 2017 ORDER:

The limited grievance of the petitioner is that he worked in the respondent-Corporation as Conductor since the year 1987 and his services were regularised with effect from 01.09.1988. He worked as such till he was removed from service in the year 2001. Therefore, he is entitled to the benefits of service rendered for the period he worked. Requesting to pay the benefits for the period he worked, the petitioner claims to have made a representation on 30.08.2010. Thereafter, he issued a legal notice dated 17.03.2017 for payment of benefits to him. Hence, this Writ Petition. 2.
Since the petitioner made representation dated 30.08.2010, to go into the validity of the claim does not arise at this stage. Without expressing any opinion on merits, the Writ Petition is disposed of directing the respondent-Corporation to examine the claim of the petitioner and take decision in accordance with law and the decision taken shall be communicated to the petitioner within three (3) months. In the meantime, it is also open to the petitioner to file claim form claiming service benefits for the period he worked. There shall be no order as to costs.
