THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6556 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to release the stock of the petitioner i.e., 90 bags of black jaggery each containing 50 kgs., and 8 bags of alum each containing 50 kgs, in Crime No.1017 of 2015-16 by the Prohibition and Excise Police Station, Jaggaiahpeta, Krishna District.
Heard and perused the material available on record.
Learned counsel for the petitioner submitted that the petitioner is doing business in purchasing and selling of jaggery and general items and he purchased the above stock from the wholesalers under valid bills and that the value of the seized stock will be diminished if it is kept in the premises of Prohibition & Excise Station.
Admittedly, black jaggery seized from the possession of the petitioner in the above referred crime is not a prohibited article under any law and its possession is also not barred by the provisions of any Statute.
Considering these circumstances, interim custody of 90 bags of black jaggery each containing 50 kgs., and 8 bags of alum each containing 50 kgs, seized in the above referred crime shall be entrusted to the interim custody of the petitioner on his execution of a personal bond for a sum of Rs.92,000/- (Rupees ninety two thousand only) to
the satisfaction of the Judicial Magistrate of First Class, Krishna District.
With the above directions, the Criminal Petition is disposed of.
Consequently, miscellaneous petitions pending if any, shall stand closed.
