This writ petition is filed declaring the action of the 4th respondent in calling the petitioner to the police station and trying to dispossess the petitioner forcibly from the land to an extent of 667 square yards of site in Survey No.159/3 in Kommadi Village, Kommadi Panchayat, Visakhapatnam District; and also the action of the 5th respondent in issuing notice dated 04.07.2018 asking the petitioner to furnish the particulars of his title over the subject property within two days at the behest of respondents 6 and 7, as illegal and arbitrary.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that on 29.06.2018, the 6th respondent herein made a complaint against petitioner stating that the petitioner and others have occupied his property and threatened him with dire consequences, when he questioned their illegal acts; that during the course of enquiry with regard to the said complaint the 4th respondent called the petitioner to the police station; and that after conducting enquiry closed the said complaint on the same day as the issue is in 'civil nature' and also entered the same in the Reception Register. All the other allegations made against the respondent police were denied. It is also stated that the respondent
police never threatened dispossession of petitioner from the subject land.
Recording the aforesaid submissions of the learned Assistant Government Pleader for Home, the writ petition is disposed of. No order as to costs. However, if the petitioner has any grievance against the 5th respondent with regard to the impugned notice dated 04.07.2018, it is open for him to challenge the same as the same is different cause of action.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
