HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.18324 of 2007 ORDER:

This writ petition is filed to declare the action of the respondents in allotting the house sites in Jupudi Village, Ibrahimpatnam Mandal, Krishna District in pursuance of the 2nd list prepared by the SubCollector, Vijayawada (3rd respondent) and the Tahsildar, Ibrahimpatnam (4th respondent), without conducting enquiry, as illegal and arbitrary.

2. At the time of admission of the writ petition, this court passed the following interim direction:

" The Respondents 2 to 5 are directed to verify the genuineness of the beneficiaries for allotment of the house sites particularly with reference to the allegations that the beneficiaries at Sl.Nos.1 to 3, 8, 12 and 14 of the second list consisting 40 names do not belong to Jupidi village and the beneficiaries at Sl.No.29 and 39 were already having house sites and landed property and therefore, they are not entitled for any house sites and take appropriate action in accordance with law land also consider the name of the petitioner for his entitlement for allotment of house site" .

3. Sri G. Seshadri, learned standing counsel for the 5th respondent submits that in view of the interim order already passed, no further orders are necessary in this writ petition. None appears for the petitioner.

4. Recording the said submission, the writ petition is closed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
