HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.36619 of 2016 ORDER:
1) Heard learned counsel for the petitioners, Government Pleader for revenue and Sri G.Seshadri, Learned Standing Counsel appearing for respondent No.5. With the consent of all the parties, the writ petition is taken up for disposal at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 to 5 in trying to demolish the petitioners' building constructed in Plot No.4 admeasuring Ac.0.07 cents situated in Sy.No.698/ 1 of Kodamur Village and Mandal, Kurnool District, without following due process of law, as illegal, arbitrary and violative of principles of natural justice; and consequently to direct the respondents not to demolish/ dispossess the petitioners from the said property. 3) Though various grounds are raised but the learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to follow due process of law.
4) Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents not to interfere with the subject property except in accordance with the due procedure laid down by law. No order as to costs.
5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
