When the matter is taken up, it is submitted by the learned counsel for the petitioner, so also by the learned Government Pleader for Excise, that the issue in this Writ Petition is squarely covered by order dated 04.02.2016 passed by this Court in WP.No.3413 of 2016. A copy of the said order is also placed on record.

In view of the same, following the order dated 04.02.2016 in WP.No.3413 of 2016, this Writ Petition is also allowed in terms thereof. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ____________________ (A.V.SESHA SAI, J) 7th June 2018 RRB
