THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No.249 of 2015 P.C: (per the Hon'ble Sri Justice Dilip B.Bhosale) Heard Sri N.Vasudeva Reddy, learned counsel for the appellants and Sri P.Venkateswara Rao, learned counsel for the respondent.

This Writ Appeal is directed against the order dated 09.07.2014 passed in W.P.No.18950 of 2014, whereby the respondent's Writ Petition has been disposed of modifying the punishment of deferment of annual increment for a period of two years with cumulative effect besides treating the suspension period as not on duty imposed by the disciplinary authority to that of stoppage of one increment without cumulative effect besides treating the suspension period as on duty.
3. The learned counsel for the parties have consented for further modification of the punishment imposed by the learned Single Judge in the Writ Petition.
4. Hence, we dispose of this Writ Appeal by the following order. The punishment imposed against the respondent by the impugned order in the Writ Petition No.18950 of 2014 is modified to that of stoppage of one increment with cumulative effect. In other words, the punishment imposed by the learned Single Judge of the stoppage of one increment without cumulative effect is modified to that of stoppage of one increment with cumulative effect. With this modification, the Writ Appeal is disposed of. Rest of the order passed by the learned Single Judge shall remain unaltered. Miscellaneous petitions pending, if any, stand disposed of. There shall be no order as to costs.
