Common Order:

AS.No.404 of 2006 arises out of award, dated 29-03-2006, in OS.No.580 of 2002, on the file of the I Additional Senior Civil Judge, Vijayawada.

The Counsel for the appellant as well as the respondents have filed a joint application, which is

registered as ASMP.No.150 of 2015, for passing a decree and judgment in terms of the compromise entered into between the parties. Along with the said application, the Memorandum of Compromise signed by the appellant and respondent Nos.2 to 5 (Legal Representatives of the deceased respondent No.1) has been filed.

A perusal of the Memorandum of Compromise shows that the parties have settled the dispute subject to the terms mentioned in clauses (i) to (v) of Paragraph 5 thereof.

At the hearing, all the parties are personally present and they have informed the Court that they have entered into the compromise on their own volition.

In the light of the above facts, ASMP.No.150 of 2015 is allowed and the Memorandum of Compromise annexed thereto is placed on file. Consequently, AS.No.404 of 2006 is disposed of in terms of the said Memorandum of Compromise.
