THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 7263 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure to quash the proceedings in C.C.No. 318 of 2017 on the file of the Court of learned Judicial I Class Magistrate for Prohibition and Excise Offences, Guntur (for short, 'the Court below').

After arguing the case for awhile, learned counsel for the petitioners has requested this Court to direct the Court below to follow the procedure laid down by the Apex Court in "Rajesh Sharma Vs. State of U.P.1". 3.

Acceding to the request of learned counsel for the petitioners, without touching the merits of the case, I find that it is a fit case to issue direction to the Court below to follow the procedure laid down by the Apex Court in Rajesh Sharma (supra). Accordingly, the Court below is directed to adhere to the guidelines issued in Rajesh Sharma (supra).

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
