HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.5805 of 2014 ORDER:

This writ petition is filed by petitioners seeking to direct respondents Nos.1 to 3 to stay the proposed construction of house in plot bearing No.15, Huda Employees Colony, Saroornagar.

The case of the petitioner is that the 4th respondent encroached upon the road margin and raised a compound wall. Due to encroachment made by the 4th respondent and other plot owners, 10 to 15 feet road is only left as passage to the residents of the colony and the said narrow road would cause much inconvenience to the residents of that locality. The petitioners made representations to the official respondents against the illegal encroachments. But no action has been taken so far. 3.

Heard and perused the material available on record. 4.

The main grievance of the petitioners is that in spite of their representations, the official respondents have not taken action against the illegal encroachments made by the 4th respondent. 5.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, this Court is inclined to pass the following order: "The official respondents are directed to consider the representations of the petitioners and take appropriate action against the illegal encroachments, if any made as alleged by the petitioners."
