HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 27256 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as regular Fair Price Shop Dealer for Shop No.

of Maddiralapadu Village, Naguluppalapadu Mandal, Prakasam District in the year 2009 after under going due selection process.

Thereafter her husband got employed as Bill Collector in the Gram Panchayat office of Karamchedu in the year 2012. Pursuant to the same, a show cause notice was issued and the petitioner submitted her explanation on 20.7.2015. Being not satisfied with the said explanation, the third respondent passed the impugned order on 7.8.2015 cancelling the authorization of the petitioner.

Challenging the same, the present Writ Petition is filed. It appears that against the impugned order, the petitioner preferred an appeal to the second respondent on 14.08.2015. With in ten days after filing of the aforesaid appeal together with stay petition thereon, the present Writ Petition is filed. In view of the availability of the appeal remedy against the impugned order and exercising of the same by the petitioner, this Court is not inclined to examine the merits or otherwise of the subject matter at this stage. However, having regard to the facts and circumstances of the case, the second respondent is directed to conduct an enquiry in the appeal preferred by the petitioner and dispose of the same with reasoned order within sixty days

from the date of receipt of a copy of this order after affording due opportunity to the petitioner.

Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
