THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.339 of 2016

ORDER

This criminal petition under sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner-A1 seeking to grant bail in connection with Cr.No.89/2015-16 of Prohibition and Excise Police Station, Peddapuram, registered for the offence punishable under Section 8 (c) read with Section 20(b)(ii)(c) of NDPS Act. 2.

Heard learned counsel for the petitioner and the learned Additional Public Prosecutor.

It is alleged that on 02.05.2015, on information, the police officials proceeded to Jaggampeta Village limits opposite to Forest Check Post at N.H.16 at about 3.00 AM, and found three persons traveling in the car and on inspection, they found 90 Kgs of ganja in 45 packets transporting illegally.

Since the contraband seized from the possession of the accused is a commercial quantity, this Court is not inclined to grant bail to the petitioner/A1.
