THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.707 of 2018 JUDGMENT:

This appeal is filed under Order XLIII Rule 1 of C.P.C. assailing the docket order dated 04.04.2018 passed in I.A.No.170 of 2017 in O.S.No.15 of 2017 on the file of X Additional District Judge, Gurajala.

A perusal of the record reveals that the trial Court passed an ex parte order on 04.04.2018 and extended the interim order from time to time.

At the time of arguments, the only relief sought by the learned counsel for the appellant is to direct the trial Court to dispose of I.A.No.170 of 2017 in O.S.No.15 of 2017 as expeditiously as possible.

In view of the submission made by the learned counsel for the appellant, this Court is not inclined to go into the merits of the impugned order.

Having regard to the facts and circumstances of the case, the learned X Additional District Judge, Gurajala, is hereby directed to dispose of I.A.No.170 of 2017 in O.S.No.15 of 2017, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order. 6.

With the above direction, the Civil Miscellaneous Appeal is disposed of. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
