THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9932 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.3, 4, 6, 8 & 9 seeking bail in the event of their arrest in connection with Crime.No.309 of 2023 on the file of Adilabad I-Town Police Station, Adilabad District, registered for the offences under Sections 143, 148, 353, 307, 324 and 427 r/w. 149 of IPC.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The allegation against these petitioners is that these petitioners and some others have attacked the persons, who were sitting in Innova car. The said vehicle was damaged. The Palvoncha Police when tried to pacify the matter, these petitioners and others did not listen to them and continued assaulting the inmates in the car.

On instructions, learned Additional Public Prosecutor would submit that group of these accused and others have assaulted the persons sitting in the car and also the police were restrained from discharging their duties.

Learned counsel for the petitioners would submit that these petitioners were falsely implicated due to previous disputes about money.

Keeping in view the circumstances of the case, these petitioners can be granted the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos. 3, 4, 6, 8 & 9 are directed to surrender before the Station House Officer, Adilabad I Town Police Station, Adilabad District, on or before 19.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos. 3, 4, 6, 8 & 9 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of eight weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos. 3, 4, 6, 8 & 9 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
