THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11032 of 2025 ORAL ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.1 in Crime No.1124 of 2025 of Vanasthalipuram Police Station, Rachakonda Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 08.08.2025 at about 6:00 p.m., the complainant received credible information that prostitution was being conducted at H. No. 58-31, Plot No. 31, Sagar Complex, BN Reddy Nagar, Vanasthalipuram. He informed his superior officers, obtained permission, and explained the matter to the panchas, who agreed to accompany him. At about 7:00 p.m., the complainant, along with his staff and panchas, went to the said house. On entering, they found one man sitting in the hall and another man with a woman in a bedroom, engaged in sexual activity. After being asked to dress, they came into the hall. On inquiry, the man in the hall was identified as the

petitioner, who confessed that he organized prostitution by bringing women in financial difficulty and calling customers. The man in the bedroom was identified as Sarikonda Srinivas Raju, a teacher, who had come to have sex with the woman for Rs.1,500/-. The woman was identified as Smt. Maddu Sujatha, a housewife. A confessional panchanama was prepared, and Rs. 1,500/-, three cell phones, and eight condoms were seized.

Heard Sri P. Manoj, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offence and he is in jail since 09.08.2025. He further submitted that there are no other cases pending against the petitioner and that the material part of the investigation has been completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the bail stating that it is a human trafficking case and the petitioner is an organizer, as such, he is not entitled to bail. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it appears that the petitioner has been in jail since 09.08.2025. As seen from the record, the material part of the investigation has been completed and nine witnesses have been examined. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned VII Additional Judicial Magistrate of First Class, Hayatnagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or

till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
