THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD W.P.No.27677 of 2019 ORDER:

It is the case of the petitioner that at the behest of the 3rd respondent, the 2nd respondent issued impugned notice dated 28.11.2019 directing the petitioner to stop the construction, for which permission dated 10.03.2019 was granted, which is still subsisting. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration, learned standing counsel for the 2nd respondent.

It is not in dispute that the notice issued by the 2nd respondent is ex facie illegal and the same is without jurisdiction and more so, the said notice is in gross violation of the principles of natural justice.

In view of the above, this writ petition is allowed setting aside the impugned notice dated 28.11.2019 issued by the 2nd respondent. There shall be no order as to costs. Miscellaneous Petitions, if any, shall stand closed. _______________________ T.AMARNATH GOUD,J Dated 17.12.2019 kvrm
