THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.27483 OF 2019 ORDER:

This writ petition is filed with the following prayer: "... to issue writ, order or direction more particularly one in the nature of the writ of mandamus by declaring the action of the respondents in issuing the notice vide Notice No.26/TPS/UC/CIR3/EZ/GHMC/2019, dated 19.11.2019, Notice No.26/TPS/UC/CIR3/EZ/GHMC/2019, dated 29.11.2019 and Notice No.26/TPS/UC/CIR3/EZ/ GHMC/2019, dated 06.12.2019, as illegal, arbitrary and violative of principles of natural justice and further direct the respondents not to interfere with the agriculture cattle shed constructed by the petitioner and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Sri P.Raghavender Reddy, learned counsel for the petitioner, submitted that the name of the petitioner is K.Venkat Reddy, but third respondent issued notice dated 06.12.2019 in the name of K.Mohan Reddy and seeks to set aside the same. 3.

A perusal of notice the third respondent dated 06.12.2019, it is evident that the notice was issued in the name of K.Mohan Reddy. Therefore, without going into the merits of the case, this Court is inclined to set aside the notice of the third respondent dated 06.12.2019 vide Notice No.26/TPS/UC/CIR3/EZ/ GHMC/2019. As it is stated that the explanation submitted to the respondents is still pending, the respondents are directed to consider the same and pass orders in accordance with law.
